We take your privacy seriously at MODO Srl, below “MODO”. This Privacy Policy applies to our e-mail communication with you in the form of newsletters.

You have signed up for our newsletter. This privacy policy informs you about how we process this data that you have submitted to us. You may at any time object to our processing of your personal data in this respect by contacting us as stated below, or by clicking the “Unsubscribe” link which is always provided in our newsletter.

MODO is established in Italy, and will always comply with applicable privacy law, including the EU General Data Protection Regulation (2017/679/EC). MODO will not disclose personal data to third parties without prior consent, unless specifically stated herein.

2. Purposes of processing

MODO may use personal data submitted by you, in order to contact you for marketing or information purposes.

MODO stores and otherwise processes your personal data, as an individual or as a representative of a legal entity, if and to the extent you have signed up for our newsletter. MODO has a legitimate interest of providing information and marketing of our products and services to you, as you have shown active interest in receiving such information.

MODO will further process your personal data to the extent that MODO is required to do so by law or a binding decision by public authorities.

Your personal data will be processed until you object to receiving our newsletter, either by informing us at the address stated below, or by using the Unsubscribe option in each newsletter. MODO will also every second year from May 25, 2018, provide a specific opt-out option in an e-mail that we will send to you.

4. Personal Data Processors and Transfer outside EU/EES

MODO allows a Data Processor to process e-mail addresses on behalf of MODO for the purpose of sending the newsletter by e-mail.

The Data Processor will store your personal data on servers that are outside the EU/EEA border. However, no information will be transferred to the Data Processor until EU Standard Contractual Clauses has been signed by MODO and the Data Processor.

5. Your rights

You are entitled to request access to and correction of personal data as well as deletion of personal data, treatment limitation or objection to treatment (if applicable according to relevant privacy legislation). Furthermore, you have a right to receive the personal data that you have provided to us in a structured, commonly used and machine-readable format (data portability). You also have the right to file a complaint with the relevant supervisory authority.

6. Changes to this Privacy Policy

MODO reserves the right to amend this Privacy Policy as required, for example to comply with changes in laws and regulations. Such a change will be available through our website.

INFORMATION COLLECTED BY “CLEAR GIFS”

MODO.COM may employ “clear GIFs” (a.k.a. Web Beacons), which are used to track the online usage patterns anonymously (i.e., in a non-personally-identifiable manner). In addition, MODO.COM may also use clear GIFs in HTML-based emails sent to users to track which emails are opened by recipients.

You must be 13 years and older to register to use the Website. As a result, MODO.COM does not collect information about children.

IN NO EVENT SHALL ANY CLAIM, ACTION OR PROCEEDING BY YOU BE INSTITUTED MORE THAN THREE (3) YEARS AFTER THE CAUSE OF ACTION AROSE.

Most communications between MODO.COM and you will be sent and received electronically. You agree that all agreements, notices, disclosures and other electronic communication exchanged between you and MODO.COM shall satisfy any legal requirements that such communications be in writing.
